All photographs and their relative XML data are the intellectual property of Patrick Allen and are protected under International copyright laws.

Images placed on this website, including the portfolio galleries, may not be downloaded except by normal viewing process of the browser.

Photographs may not be copied to another computer, transferred, transmitted, published, reproduced, stored, manipulated, projected or altered in any way, including and without limitation any digitalization or synthesizing of the images, alone or with any other material, by use of computer, or any other electronic means, now or hereafter known, without the appropriate written permission.

Use of any P M Allen's images, as the basis for another photographic concept, illustration or application is a violation of copyright.

Unauthorized use:
(not exclusively limited to, but do firmly include)  … P M Allen's images may never be used …
— to infringe upon any copyright, trade name, trademark, or service mark of any person/entity …

— as / or being part of a, trademark or service mark — (unless the appropriate additional extended license is purchased) …
— in the production of any form of pornographic related content or materials, and / or for or any other unlawful purposes …
— to defame any individual or group, nor to violate any individual or group's rights to privacy …

Any unauthorised use of any of P M ALLEN images constitutes copyright infringement and will entitle PM ALLEN to exercise all rights and remedies under applicable copyright law, including an injunction preventing further use and monetary damages against all users and beneficiaries of the use of such Images.

 

Penalties applicable for unlawful use:

Notification of unlawful use, of any of P M Allen's images, in any derivative, commercial and/or otherwise, this concurrently implies you [ infringing party ] do agree to make payment of any/all penalties, on demand from myself  [Patrick Allen ], photographer, a.k.a RatManDude, or my legally appointed representatives. In the event of notification of illegal use, of any/all images owned by myself [ Patrick Allen, a.k.a RatManDude ], You [ infringing party ] agree to an automatic license fee, levied for "any prior, unlawful use".

 

The value of said levy as at — 01 January 2011 — € 750 / £ 650 / U$D 1,000 — whichever is the lowest, specific to my effective currency exchange rates, I.E. relative to the active currency of my domicile. Currently, South African Rand [ ZAR ]. Penalty demanded in lieu of damages for each instance, of each photograph, and for every instance of unlawful / unlicensed use. Aforementioned penalty is understood and accepted as reasonable compensation, immediately due and payable by You [ infringing party ] to myself [ Patrick Allen ].

 

Annual escalation applicable @ 10% … in perpetuity … automatically accrued at the start of each new calendar year  …
